     #  Adin contra guerra fiscal 

 O governador do Paraná, Roberto Requião, propôs no Supremo Tribunal Federal (STF) ação direta de inconstitucionalidade (Adin) contra dispositivos de legislação mineira sobre Imposto sobre Circulação de Mercadorias e Serviços (ICMS). Trata-se do Decreto 43.891 de outubro de 2004 que estabelece, segundo o governo paranaense, benefício fiscal para operações internas com farinha de trigo em prejuízo de produtos vindos de outros estados. A Procuradoria Geral do Estado de Paraná (PGE-PR) reforça que a norma impugnada dá tratamento tributário discriminatório em função da origem das mercadorias, o que seria inconstitucional, pois privilegia apenas os contribuintes sediados em Minas Gerais prejudicando o livre comércio entre os estados da federação.(Gazeta Mercantil)
